General Information/ Current Status:

This is a lawsuit to recover a fraudulent transfer totaling $87,280.00 from Brad Stark's brother. On August 10, 2006 the Receiver filed his Complaint. On October 2, 2006 the Defendant filed his Answer.

On March 5, 2007 the Receiver filed his Motion for Summary Judgment. On March 29, 2007 the Defendant filed his Response to the Receiver's Motion for Summary Judgment. On April 12, 2007 the Receiver filed his Reply Brief. On October 1, 2007 the Court entered its Order and Judgment awarding the Receiver $95,506.44 in total damages plust post-judgment interest.

In attempting to collect on this judgment, the Receiver determined that Defendant was unable to pay the full judgment amount. The most Defendant could realistically pay given his financial situation was $65,000.00. Therefore, the Receiver sought and obtained permission from the Court to accept that amount in full satisfaction of his judgment. The Receiver believes that this achieved the highest recovery possible with least expense to the receivership estate.
