General Information/ Current Status:

This is a lawsuit to recover fraudulent transfers totaling in excess of $189,000.00 from an associate of Bradley Stark. On October 28, 2005 the Receiver filed a Complaint. On November 21, 2005 the Defendant filed an Answer. On December 12, 2005 the Court entered an Order requiring a Joint Status Report. On January 3, 2006 the Receiver filed a Status Report without input from the Defendant. On January 3, 2006 Defendant's counsel filed a Notice of Appearance as well as an Amended Status Report. On January 5, 2006 the Court entered an Order Regarding Case Management and Scheduling.

On September 6, 2006 the Receiver filed his Motion for Summary Judgment. Defendant filed his Response on December 6, 2006. On December 15, 2006 the Receiver filed his Reply Brief.

On December 19, 2006 the Court filed its Memorandum Opinion and Order and Final Judgment. On February 13, 2007 the Defendant filed his Motion to Vacate Final Judgment for Summary Judgment. On March 7, 2007 the Court entered its Memorandum Opinion and Order denying Defendant's motion.

On January 10, 2007 the Defendant filed a Notice of Appeal. On October 12, 2007 the United States Fifth Circuit Court of Appeals entered its Opinion and Judgment in favor of the Receiver.
